Queer Podcast Community

Any ideas on using copyrighted "fair-use" sound clips? Like a 5-second clip of a mainstream song without the RIAA coming after you? I've heard MANY full songs on podcasts, but I'm not sure what sort of paperwork I'd have to go through... Isn't there some sort of "fair-use" clause if the clip is under 5 seconds?

I've done both podsafe and regular music tracks for a year, and no one has ever said anything. I think the idea is that if you are a podcast for profit... that's an issue. Most of us are doing this for free.. we aren't doing anything but pushing a label's music for them and giving them more attention, with no benefit to ourselves.

I've used the rule of talking over part of a song for a long time, and that seems to work. Althought lately... I'm starting to use the whole song if I want to. If they have a problem with it, they can tell me to stop.

Here is the website with the answer to your question http://publishing.wsu.edu/copyright/music%5Fcopyright/ I thought they allowed a certain time period but it looks like even .1 seconds is an infringement now. I think people can do what they want, but knowing my luck I use the websites below ....

The above are creative commons websites I use for my podcast. The music on them used to suck -- but in the past three months they have gotten to the point where the music is professionally produced and decent to use. Actually now, I even prefer some of the artists there to my mainstream music queue.

Hey Mikey... I play all kinds of full length 80's music in the background and in the foreground of my podcast. Do you think this is alright, or should I worry? Will iTunes yank my podcast off their systems? Just curious.

iTunes will yank your podcasts if they get any complaints about you playing music you shouldn't be playing. The law says that you can play up to 30 secs of a song without a license for it. Talking over it don't count. I don't think most artists or music companies really care as long as your not making money off it. But if they wanted to, they could drag you into court and slap a hefty fine on you for it. And odds are they would win, as they win 99% of the cases they press. I would be very careful about what you play on your podcast. Not telling anyone what to do, just warning you.
